Do you need to apostille a certificate of birth?
If you were born in the United States, your birth certificate can be apostilled from the State that issued it. For example, if you were born in California, the California Secretary of State can apostille your certificate. If you were born in Texas, the Texas Secretary of State can apostille your certificate. Currently, there are 113 countries who are members of the Hague Apostille Convention. The most recent countries to join the Convention are Chile, Brazil, and Morocco.

Beware of companies who offer to copy certify your birth certificate through a State other than the one you were born in. For example, obtaining a New York apostille on a Texas birth certificate. Only the Secretary of State of the State that has issued your documents has the authority to apostille it. Some companies may ask you to upload your documents and pay a copy certification fee. This type of behavior is reckless and fraudulent. Only the State that has issued your document has the authority to apostille it.
Every State has specific rules on what is acceptable to be apostilled. For Example, in the State of California, a birth certificate issued from the Health Department cannot be apostilled. Only a birth certificate issued by the County Clerk or State office can be apostilled. In New York, a birth certificate needs to be authenticated by the County Clerk before the State will attach apostille. For the States of Wisconsin and Virginia, a birth certificate must be issued within the past 12 months. Not every State has the same requirements.
