US Department of State Apostille Processing Time During COVID-19

Do you need to apostille your documents through the US Department of State – Office of Authentications in Washington, D.C.?

An apostille is a certificate issued by the US Department of State which authenticates the official who has signed your U.S. Federal documents. Since 1980, the United States has been a member of the Hague Apostille Convention.

What was once a four-business day turn around to obtain a U.S. Department of State Apostille has now increased to an unheard of 8-12 weeks with no indication that the processing time will subside this year. Since March 20, 2020, the US Department of State – Office of Authentications has closed their in-person counter service thus eliminating the quick turn-around time most people and businesses have been accustomed to.

We can estimate that the U.S. Department of State will not reopen their in-person counter service until February 2021. We believe the delays are because of the ongoing health risks related to COVID-19, limited staff, potential delays in DC in the coming months, and the upcoming 2020 Presidential election.

The US Department of State requires all documents submitted to also include Form DS-4194. If you have questions on how to complete Form DS-4194, please contact our Washington DC apostille office.

The most common document we apostille through the US Department of State is the FBI background check.  If you need to apostille your FBI background check, a good rule of thumb is to obtain a recent copy and immediately overnight or e-mail it to our office for processing. We can apostille a digital FBI background check in a PDF format or the hardcopy. Most countries will accept a background check issued within the past 90 days with an apostille. Please double check with your contact in the foreign country. We have also learned that the Consulates of Spain and Italy have been flexible in dealing with the delay of obtaining an apostille on the background check.

FBI Apostille

Do you need to apostille your FBI Background Check?

Criminal Background Check Apostille

Have you been asked to obtain an apostille on your Criminal Background Check?

A background check can be issued by the local Police, Sheriff’s Department, State, and the FBI.  We recommend that you obtain your background check from the FBI. It’s the easiest to obtain and covers all U.S. states and the U.S. Federal Government.

In order to apostille your background check, you must mail in the original or a certified copy to our office for processing.  Digital FBI background checks can be sent by email to our Washington DC apostille office.  A Background check issued from the local Police, Sheriff, or State office can only be authenticated from the State of issue.  The Secretary of State does not have the authority to authenticate documents issued from another State. For example, if your background check is from the State of California, the State of California is the only state that can issue the apostille.  Another example is if your background check is from New York, only the State of New York can issue the apostille.

Local Police Station Background Check – If the requesting country is requesting a local Police background check, then all you need to do is have a letter drafted and notarized by the local police department.  Once your background check is ready to be picked-up, you will need to contact a local traveling notary to meet with the Officer to notarize his/her signature on the document.  The notary will also need to use the correct notarial wording for the State.  Once complete, mail the notarized background check with our order forms to our office for processing.

Local Sheriff’s Department Background Check – If the requesting country is requesting a local Sheriff’s Department background check, then all you need to do is have a letter drafted and notarized by the local Sheriff’s department.  Once your background check is ready to be picked-up, you will need to contact a local traveling notary to meet with the Deputy to notarize his/her signature on the document.  The notary will also need to use the correct notarial wording for the State.  .  Once complete, mail the notarized background check with our order forms to our office for processing.

Department of Justice Background Check(DOJ) – Office of the Attorney General – Obtaining a background check from the State’s Department of Justice can be a little more complicated.  For example, if you are in California, you’ll need to contact the California Department of Justice (DOJ) and obtained a signed letter after you have received the digital results.  The Office of the Attorney General of your State will provide you step-by-step directions.  Please note that not all state offices issue a background check.  They may direct you to the local Police or Sheriff.

FBI Background check  The first step in obtaining your FBI Background Check is to contact an FBI Approved Channeler. An FBI Channeler will provide you step by step instructions including sending you a fingerprint card. Once you receive your background check, you can then mail-in this document to our Washington DC apostille office for processing.  If you are located outside of the country and need to obtain your FBI background check, the FBI approved Channeler will provide you instructions on how to obtain a digital copy of your FBI background check.  Once you receive the digital copy, you can email it to our with our FBI apostille order forms for processing.

FBI Apostille Washington DC

Do you need an apostille on your FBI background check?

Most countries will accept an FBI background check issued within the past three months.  If your background check is older than three months, please contact us for instructions on how to order a new copy.  Please note that FBI background checks can only be processed through our Washington DC apostille office. This document is a U.S. Federal document and cannot be notarized or processed through a Secretary of State office.

FBI Channelers can issue a digital copy of your background check in a PDF Format and a hard copy. The digital copy can be e-mailed to you while the hard copy will be physically mailed to your address.   If you are in a foreign country, be sure to request a digital copy to save time and money.

As of March 2019, the current processing time is four business days.  This is the fastest processing time available. No service company can process faster than four business days.

Documents received at our Washington D.C. apostille office by 2pm are submitted the following business morning to the US Department of State.  Once complete, the documents are then shipped by FedEx priority overnight.  Our fees are all inclusive including the FedEx overnight return shipping.  If you require international shipping, please contact us for a quote.

Background Check Apostille

In addition to an FBI background check apostille, some countries may ask for you to produce a background check from the last State you lived in.  For example, if your last place of residence was California,  you may be asked to provide a background check from the State of California in addition to an FBI background check.

Note: Most countries will only require a background check from the FBI issued within the past three months.

It’s important to note that we cannot recommend what type of background check you will need.  We can only assist you in processing your background check through the State or US Department of State.

Background checks can be issued by the Police, County, Sheriff, State (Example: California Department of Justice), and FBI.  If you choose to obtain your background check from the Police or Sheriff’s Station, you will need to have the document signed and notarized.  A traveling notary will need to travel to the Station and have the officer’s signature signed and notarized.  If you obtain your background check from the County Clerk, Superior Court, or the State, this document does not require notarization unless it’s provided to you already notarized.  FBI background checks are not notarized as they are considered US Federal documents FBI background check are processed through our Washington DC apostille office.

If you are unsure of who should issue your background check, 95% of background checks we apostille are issued from the FBI. We recommend that you ask the people requesting your document who should issue the background check.

You can elect to receive your FBI background check by regular mail, e-mail, or both.  If you are outside of the USA, we suggest that you obtain a digital copy of your FBI background check in order to save time and money.  The FBI channeler will either email you a .PDF copy of your background check or provide you login information to obtain it from their website.
