A Certificate of No Impediment for Marriage, also known as a “Certificate of Freedom to Marry,” is a document issued by a government official (County Clerk’s office) that states that there are no legal impediments to a person getting married. It is typically required by foreign governments as proof that a person is legally able to marry before allowing them to wed in their country. The requirements for obtaining a Certificate of No Impediment for Marriage vary depending on the country and jurisdiction. In general, it involves providing proof of identity, proof of marital status (e.g., a divorce certificate or death certificate if the person is widowed), and sometimes a FBI background check apostille.

The first step is to contact the local County Clerk’s office to request a document that states you are currently not married   Most all County Clerk offices can provide you this document so please be sure to speak to a supervisor if you are told otherwise.  A document issued from the County Clerk’s office does NOT require notarization.

If the County Clerk is unable to assist you and you are in the United States, you can use the sample above to write your own single status affidavit.  Basically, you are writing a sworn statement stating that you are currently not married to another person in the United States.  Be sure to have this document signed and notarized before you mail it in to our office. You should also check with the people requesting your single status if they will accept a sworn affidavit directly from you.

If you are outside of the United States, the local US Embassy or US Consulate office should be able to assist you in completing a single status and also having it signed and notarized.  Because you will be visiting a U.S. Federal Government office and having your document signed and notarized by a US Federal notary public, this document can then only be apostilled through our Washington DC apostille office.

Spain Golden Visa Apostille

Are you planning to live in Spain and need to obtain the Golden Visa?  Have you been asked to apostille your documents for Spain?

Spain’s Golden Visa program is a residence permit program that allows non-European Union citizens to live in Spain for a certain period of time, in exchange for making a significant investment in the country. The specific requirements for the program vary depending on the type of investment made, but generally, individuals must make an investment in Spanish property, government bonds, or other financial assets.

The most common way to obtain a Golden Visa in Spain is by purchasing a property.

The Golden Visa grants the holder the right to live and work in Spain for a renewable period of five years, and after that, they may apply for permanent residency. It also allows visa-free travel throughout the Schengen Area and access to Spanish healthcare and education system.

It’s important to note that the Spanish government has the right to revoke the Golden Visa if the holder does not comply with the conditions of the program, such as not residing in Spain for a certain amount of days every year.

Portugal Golden Visa and Apostille

Power of Attorney Apostille for the Philippines

Do you need to apostille a Special Power of Attorney (SPA) for the Philippines?

The Philippines is a member of the Hague Apostille Convention.  Documents destined for the Philippines no longer requires the red ribbon or red seal from the Philippines Embassy or Consulate office.  The apostille issued by the Secretary of State is sufficient for the special power of attorney to be accepted in the Philippines.

A special power of attorney is a legal document appointing a specific representative (to be called an agent or attorney-in-fact) to act on behalf of another person who will be referred to as the principal.  The special power of attorney authorizes your agent/attorney in fact to do specific acts and functions for you in the Philippines.

In order to apostille the special power of attorney, it must first be signed and notarized.  Please meet with a local notary public before you mail in your documents for processing.

IRS Form 6166 Apostille for Portugal

Do you need an apostille on IRS Form 6166 for Portugal?

U.S. treaty partners require the IRS to certify that the company or person claiming treaty benefits is a resident of the United States for the federal tax purposes. The IRS provides this residency certification on Form 6166.  This letter is typically referred to U.S. Residency Certification.

Form 6166 is a letter printed on U.S. Department of Treasury stationary certifying that the company or person is a resident of the United States for purposes of income tax laws of the United States. You may use this form to claim income tax treaty benefits and certain other tax benefits in foreign countries.

Here is an example of IRS Form 6166:

If you are planning to teach in a country who has a tax treaty with the United States, you can possibly avoid being taxed twice.  We recommend that you contact the IRS to know if the country has a tax treaty with the United States.

Many business set up representation in foreign countries in order to conduct business in that country.  If the country has a tax treaty with the United States, the individual or company must provide proof to the foreign government in order to qualify for the reduced tax rate.  Form 6166 is also used to claim exemption from a VAT (Value Added Tax) imposed by a foreign country.

Tax treaties may allow residents of foreign countries to be taxed at a reduced rate.  This helps prevent double taxation or a reduction in taxes owed.

In order to obtain an apostille on Form 6166, you must first obtain this document by completing form 8802.  It is estimated that you will receive this form in a few weeks from the IRS.  Once you have received the form printed on the Department of Treasury stationary, you can then mail-in this letter to our Washington, D.C. office for processing through the U.S. Department of State.

Will and Trust Apostille

Do you need to apostille a Will and/or a Trust?

How to apostille a Will or Trust?  In order to apostille a Will or Trust, they either need to be signed and notarized, copy certified with a notary public (Example: Attorney certifies the copy is a true copy of the original), or filed with the Court whereas a Court certified copy is produced.  A Court certified copy must have the name and signature of the Clerk of the Court/Deputy Clerk, and the seal/stamp of the Court.  In certain situations, the seal is embossed and/or color stamped.

A Will is typically not notarized.  If you need to apostille a Will and it’s not notarized, you can make a copy of the original Will and certify it with a notary public.  For example, you can make a copy of the Will and write a cover letter stating that the attached Will is a true copy of the original.  The cover letter which is basically a sworn statement is signed and notarized.  You can also ask an attorney to certify it with a signed and notarized cover letter.  The third option is to obtain a certified copy from the Court assuming the copy was filed with the Court.

Trust documents are typically signed and notarized.  You can mail in the original signed and notarized documents or have the attorney certify them with a signed and notarized cover letter.  You can also obtain a certified copy from the Court assuming the copy was filed with the Superior/Family Court.

Please note the information is based off of our experience obtaining an apostille on a Will or Trust documents from our clients.  Please double check with the requesting country on what is required in order to avoid delays or additional costs.

Certified Divorce Decree Apostille

Do you need to apostille a Divorce Decree?

Are you planning to get married in a foreign country?

In order to apostille your divorce decree, you must mail in the original or a certified copy issued by the Court.  In some States, this Court can also be called the Family Court, Superior Court, County Court, and Circuit Court.

Divorce decrees can only be authenticated from the State of issue.  The Secretary of State does not have the authority to authenticate documents issued from another State. For example, if your divorce decree is from the State of California, the State of California is the only State that can issue the California apostille.  Another example is if your marriage certificate is from Florida, only the State of Florida can issue the Florida apostille.

If you had hired an attorney to help you with your divorce, your attorney should have supplied you with a certified copy of your divorce decree.  If not, your attorney can obtain one from the court and overnight it to your location or recommend a service who can obtain a certified copy from the court directly.

Not every divorce decree can qualify for an apostille.  Some States have set time limits on how old a certificate can be.  For example, divorce decrees issued from the State of Virginia can not be older than 12 months. We recommend that you mail in the documents you currently have for review.  If the State rejects your document, we will contact you with instructions.

Please be sure your certified divorce decree is signed and stamped by the Clerk of the Court.  The certified copy should also have an embossment (raised seal) or a Court stamped color seal.

Note: Some states may allow you to obtain a digital certified copy.
